3 round burst is only legal if you have the gun registered with the Feds as a full auto firearm.
There is the binary firing system that the Feds have decided is legal.
It shoots once on the trigger pull and once on the release of the trigger.
Is 3 round burst considered fully automatic?
3 shot burst is legally full-auto. Semi auto is ONLY one trigger pull per round fired. Any more than one round fired per pull is considered automatic and you must get a class 3 license to own one.
Are burst weapons illegal?
Yes. Under US law and BATFE regulations a burst fire weapon is a machinegun. Even if continuous fire is arrested by a mechanism in the firearm itself, e.g. – burst mode, exceeding the ratio of 1:1 for rounds fired per trigger pull would legally be automatic fire.
